Terms of Service

Effective date: June 15, 2026

These Terms of Service ("Terms") govern your use of the Zakatable platform ("Zakatable"). Zakatable is a product of Bright Thoughts Technologies, LLC ("Bright Thoughts", "we", "us", "our"). By creating an account, registering an organization, or otherwise using Zakatable you ("you", "Customer") agree to these Terms. If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization.

If you do not agree to these Terms, do not use Zakatable.


1. The service

Zakatable provides a software-as-a-service platform for US-based mosques, Islamic charities, and 501(c)(3) nonprofits to receive, evaluate, prioritize, and disburse Zakat and other forms of community financial and non-financial assistance. The platform includes:

  • An organization administrator portal for managing applications, members, rules, events, announcements, and disbursements.
  • A community portal and mobile app for applicants to submit and track assistance requests, communicate with organizations, and discover events.
  • Optional AI features: AI-assisted application assessment, AI chat assistant, and AI phone-intake (when explicitly enabled).
  • Integrated identity verification, EIN verification, sanctions screening, and subscription billing and ACH disbursements via our payment processor.

We may add, change, or remove features over time. Material changes that adversely affect your subscription will be communicated by email at least 30 days in advance.


2. Accounts

2.1 Eligibility

You must be at least 13 years old to create a personal applicant account (and at least the age of majority in your jurisdiction to register an organization). You must provide accurate, current, and complete information, and keep it up to date.

2.2 Credentials

You are responsible for maintaining the confidentiality of your login credentials and for everything that happens under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

2.3 Organization accounts

A person who registers an organization (the "Organization Administrator") represents and warrants that they are authorized to act on the organization's behalf, that the organization is a bona fide 501(c)(3) nonprofit or equivalent, and that the EIN provided is accurate. We verify EINs at signup using public IRS records; submitting a false or stolen EIN may result in immediate account termination and is grounds for referral to the appropriate authorities.


3. Acceptable use

You agree NOT to use Zakatable to:

  • Engage in any illegal activity, or facilitate illegal activity by others.
  • Commit or facilitate fraud, including submitting fictitious applications, misrepresenting an applicant's circumstances, falsifying organization status, or laundering funds.
  • Bypass IRS donor-disclosure requirements, structure donations to evade reporting thresholds, or otherwise interfere with applicable tax-law compliance.
  • Send unsolicited bulk messaging (spam) through the platform's messaging or notification features.
  • Harass, threaten, defame, or harm any person, including applicants, other organization members, or Zakatable staff.
  • Attempt to access another organization's data, scrape data not intended for you, reverse-engineer the platform, probe security beyond your own account, or conduct unauthorized vulnerability research.
  • Resell, sublicense, or commercially exploit Zakatable outside your organization's intended use of the service.
  • Upload malicious code, viruses, or content designed to disrupt the platform or other users.

Violation of this section is grounds for immediate suspension or termination of your account without refund.


4. Applicant integrity

Applicants represent that the information they submit (income, household size, identity documents, need description) is true and complete. Knowingly false applications may be rejected, may result in account termination, and may be reported to law enforcement or the affected organization where required by law.


5. Pricing, subscriptions, and payment

5.1 Subscription plans

Zakatable is offered on subscription plans (FREE, PRO, PREMIUM, ENTERPRISE, and optional add-ons such as AI Phone Assistance). Plan features, limits, and prices are listed at https://app.zakatable.org/admin/ under the Subscription page and may change with at least 30 days notice.

5.2 Billing

Paid plans are billed monthly or annually in advance via our payment processor (ACH or credit card). Subscriptions auto-renew at the end of each billing period unless canceled. Disbursement and payment-processing fees charged by our payment processor are pass-through and are not refunded by Zakatable.

5.3 Trials

We may offer a free trial for new organizations. The trial converts to a paid subscription at the end of the trial period unless you cancel before the period ends.

5.4 Refunds

Refunds are handled under our Refund Policy at https://app.zakatable.org/legal/refund. In summary: we offer a 14-day money-back guarantee on the first paid month; annual subscriptions are pro-rated only if canceled within the first 30 days. After that, partial- period charges are not refundable.

5.5 Taxes

Prices are exclusive of any applicable sales, use, VAT, or similar taxes, which you are responsible for.

5.6 Failed payments

If a charge is declined we will retry per our payment processor's standard retry schedule. Repeated failure may result in service suspension; we will notify you by email before suspension takes effect.


6. Customer data

6.1 Ownership

You retain ownership of all data you submit to Zakatable ("Customer Data"). For organizations, Customer Data includes applications submitted by your applicants for assistance from your organization, internal notes, disbursement records, and member information.

6.2 License to operate

You grant Zakatable a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and otherwise use Customer Data solely to (a) provide the service to you, (b) protect the platform from abuse, (c) comply with law, and (d) generate aggregated, de-identified analytics to improve the product.

6.3 Confidentiality

We treat Customer Data as confidential and protect it under our Privacy Policy. We do not sell Customer Data. We do not use Customer Data to train third-party AI models.

6.4 Export and deletion

You may export your organization's Customer Data at any time via the admin portal. Upon termination, we will retain Customer Data for 30 days during which you may export it; after that we delete it on the schedule described in our Privacy Policy (donation records may be retained longer where law requires).


7. AI features

Zakatable offers optional AI-powered features (AI-assisted assessment, AI chat assistant, AI phone-intake). When enabled:

  • AI output is advisory only. Final decisions on applications, disbursements, member actions, and any operational decision remain the responsibility of the organization's human reviewers.
  • We use enterprise model APIs under terms that prohibit training on customer data.
  • AI may produce errors, omissions, or hallucinations. Do not rely solely on AI output for legal, financial, medical, or compliance decisions.

8. Third-party services

Zakatable integrates with third-party service providers — for payment processing, identity verification, communications delivery, AI processing, infrastructure/security, and address/registry lookups. Your use of those services may be subject to their own terms. We are not responsible for third-party service outages, data handling outside our processor agreements, or third-party fee changes.


9. Intellectual property

9.1 Zakatable IP

Zakatable, its logos, the platform software, documentation, and all related intellectual property are owned by Zakatable or its licensors and are protected by US and international law. These Terms do not grant you any rights in our intellectual property except as required to use the service.

9.2 Feedback

If you give us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without obligation to you.


10. Term, suspension, and termination

10.1 Term

These Terms apply for as long as you have an account. Subscriptions continue until canceled.

10.2 Cancellation by you

You may cancel your subscription at any time via the Subscription page in the admin portal. Cancellation takes effect at the end of the current billing period unless you also request immediate cancellation.

10.3 Suspension or termination by us

We may suspend or terminate your account immediately, without refund, if you materially breach these Terms (especially Section 3 — Acceptable use), fail to pay, or where required by law. For non-material breaches we will give you written notice and a reasonable opportunity to cure where practical.

10.4 Effect of termination

On termination, your right to use the service ends. We will retain Customer Data for 30 days for export as described in Section 6.4. Sections that by their nature survive termination (IP, liability, governing law, indemnification) will survive.


11. Warranty disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ZAKATABLE DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA WILL BE SECURE OR NOT LOST OR ALTERED.


12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • ZAKATABLE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, WHETHER IN CONTRACT, TORT, OR ANY OTHER THEORY.
  • ZAKATABLE'S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO ZAKATABLE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the limitations above; in those jurisdictions the limitations apply to the maximum extent permitted by law.


13. Indemnification

You will indemnify, defend, and hold harmless Zakatable, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) Customer Data you submit to the platform.


14. Governing law and disputes

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. The state and federal courts located in the State of Arizona have exclusive jurisdiction over any dispute arising out of or related to these Terms or the service, and each party consents to the personal jurisdiction of those courts.

If you are a consumer (not an organization), nothing in this section deprives you of mandatory consumer-protection rights in your jurisdiction of residence.


15. Modifications

We may modify these Terms from time to time. Material modifications will take effect 30 days after we email organization administrators or post the update on our site, whichever is earlier. Continued use of the service after the effective date constitutes acceptance. If you do not agree to the modifications, cancel your subscription before the effective date.


16. Miscellaneous

  • Assignment: you may not assign these Terms without our written consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
  • Entire agreement: these Terms (together with the Privacy Policy and any plan-specific order form, or signed DPA where applicable) are the entire agreement between you and us regarding the service.
  • Severability: if any provision is unenforceable, the rest remains in effect.
  • No waiver: failure to enforce a provision is not a waiver of our right to enforce it later.
  • Force majeure: neither party is liable for failure to perform due to causes beyond reasonable control (natural disaster, war, internet outage, government action).
